The legal basis for collecting personal information is grounded in the EU-regulation General Data Protection Regulation (GDPR) and its national implementations (for Germany: (DSGVO) Datenschutzgrundverordnung).

Furthermore, build_shift’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the personal information we collect and the specific context in which we collect the information:

  • build_shift needs to perform a contract with you
  • You have given build_shift permission to do so
  • Processing your personal information is in build_shift legitimate interests
  • build_shift needs to comply with the law
3. Data Protection Officer

A data protection officer does not have to be appointed according to Art. 37 Abs. 4 DSGVO i.V.m. § 38 Abs. 1 BDSG.

4. Use and Purpose of Log Files

build_shift follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this as part of hosting services’ analytics. 

The information collected by log files can include 

  • internet protocol (IP) addresses,
  • browser type, 
  • Internet Service Provider (ISP), 
  • operating system used, 
  • visited websites, 
  • date and time stamp, 
  • referring/exit pages, 
  • amount of sent data in byte, 
  • and possibly the number of clicks. 

This information is technically necessary in order to correctly deliver the content you have requested from websites and is mandatory when using the internet. Therefore, the purpose of the information is for 

  • analyzing trends, 
  • administering the site, 
  • tracking users’ movement on the website, 
  • gathering demographic information,
  • ensuring a problem-free connection to the website,
  • ensuring smooth use of my website,
  • as well as evaluation of system security and stability.

These are not linked to any information that is personally identifiable.Under no circumstances build_shift uses the collected data for the purpose of drawing conclusions about your person.

The legal basis for data processing is Art. 6 Abs. 1 S. 1 lit. f DSGVO. Our legitimate interest follows from the data collection purposes listed above.

build_shift uses the open source content management system WordPress, an offer from Automattic, Inc. 132 Hawthorne Street San Francisco, CA 94107, USA. This means that your data mentioned under the Privacy Policy will also be stored on servers in the USA. WordPress assures that this data will only be passed on to third parties due to existing regulations; third party means other natural or legal persons than WordPress, Automattic Inc. or the operator of build_shift. 5. Use and Purpose of Cookies

Like any other website, build_shift uses ‘cookies’. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information.

build_shift uses the Jetpack plugin, which integrates a tool for the statistical evaluation of visitor access and comes from Automattic. Jetpack uses the so-called cookies, text files that are stored on your computer and enable an analysis of your use of the website.

The information generated by the cookie about your use of this online presence is stored on a server in the USA. User profiles can be created from the processed data, which are only used for analysis and not for advertising purposes. Other services that we use and might use Cookies and store collected information are: Font Awesome, Google Analytics, Google Fonts, Gravant, WordPress Emojies and embeds of external URLS.

The data processed by cookies are required for the purposes mentioned to protect our legitimate interests and those of third parties in accordance with Art. 6 Abs. 1 S. 1 lit. f DSGVO.

You can choose to disable cookies through your individual browser options. Common browsers offer the setting option not to allow cookies.

There is no guarantee that you will be able to access all functions of this website without restrictions if you make the appropriate settings.

Our website may link to external sites that are not operated by us. build_shift’s Privacy Policy does not apply to other advertisers or websites. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies. 

Thus, we are advising you to consult the respective privacy policies of these third-party ad servers for more detailed information. It may include their practices and instructions about how to opt-out of certain options.

7. Our Private Policy in Regard to our Special Services.    
7.1 Newsletter

build_shift offers a newsletter that provides information about current job vacancies and news. If you have given your express consent in accordance with our Privacy Policy, we will use your email address to send you our newsletters on a regular basis. To receive the newsletters, it is sufficient to provide a valid e-mail address.

The newsletter is registered and sent using The Newsletter Plugin from Stefano Lissa & The Newsletter Team. The Newsletter Plugin provides all the technical tools needed to achieve GDPR compliancy and does not collect users’ own subscribers data, nor it has any access to those data.

You can revoke your consent to receive the newsletter at any time and thus cancel the newsletter subscription. After your termination, your mail-adress will be deleted. At the same time, your consent to the sending of the newsletter expires. You will find the link to cancel at the end of each newsletter. Alternatively, you can send us your unsubscribe request at any time by email.

7.2 Reporting a Vacancy:

On our website, we offer you the opportunity to report a vacancy. Depending on the channel you use to contact us, we may see at least the mail address you use or the public information you share on your Instagram or LinkedIn profile. Unless you specifically decline to allow us to respond to your messages, you consent that we process the given information and that we can contact you for possible queries. Your name and contact information will not be published.

7.3 Contacting us via one of our email addresses or social network profiles

Depending on the channel you use to contact us, we may see at least the mail address you use or the public information you share on your Instagram or LinkedIn profile. Unless you specifically decline to allow us to respond to your messages, you consent that we process the given information and that we can contact you for possible queries. Your name and contact information will not be published.

8. Voluntary Payments

build_shift offers the option of transferring voluntary payments to our account for our service. Depending on the payment method we choose, we see different details.

  • bank transfer: From natural and legal persons who use this option, build_shift sees the name of the account holder and the account details on the bank statement and in the online banking.
  • Paypal: We will see the public details you have stored in your PayPal account, usually this is your name and a profile picture if applicable.
  • Revolut: We will see the public details you have stored in your PayPal account, usually this is your name and a profile picture if applicable.
  • For other options, we will consider on a case-by-case basis what details and information you are required to provide to us and whether you consent to their disclosure.
9. Transfer of Personal Data to Third Parties

Your personal data will not be transmitted to third parties for purposes other than those listed below. build_shift will only share your personal information with third parties if:

  • you have given your express consent to this in accordance with Art. 6 Abs. 1 S. 1 lit. a DSGVO,
  • the transfer according to Art. 6 Abs. 1 S. 1 lit. f DSGVO is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,
  • in the event that there is a legal obligation for the transfer according to Art. 6 Abs. 1 S. 1 lit. c DSGVO,
  • it is legally permissible and required for the processing of contractual relationships with you in accordance with Art. 6 Abs. 1 S. 1 lit. b DSGVO.
10. Your Rights

If you are a resident of the European Economic Area (EEA), you have certain data protection rights.

As a user, you have the right to request free information about what personal data has been stored about you. You also have the right to have incorrect data corrected and the processing of your personal data restricted or deleted. If applicable, you can also assert your right to data portability. If you assume that your data has been processed unlawfully, you can lodge a complaint with the responsible supervisory authority.

If your request does not conflict with a legal obligation to store data (e.g. tax requirements), you have the right to have your data deleted. Data stored by us will be deleted if they are no longer required for their intended purpose and there are no statutory retention periods. Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

build_shift does not knowingly collect any personal identifiable information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

build_shift reserves the right to adapt this Privacy Policy so that it always corresponds to the current legal requirements or to implement changes to our services in private policy, e.g. when introducing new services. The new Privacy Policy will then apply to your next visit.
